3. Scope and purpose of processing personal data

When browsing this website, data are automatically sent by visitor’s browser to the server of this website and saved in a logfile for a limited period of time. Until automatic deletion, the following data are saved without further entry by visitor:

  • IP address of accessing device,

  • Date and time of access,

  • Name and URL of requested website,

  • Referrer URL,

  • Browser and operating system of visitor’s device as well as name of access provider used by visitor.

Processing of these personal data is justified by Article 6 para. 1 sentence 1 lit. f) GDPR. Dr. Jakob & Partner Steuerberatungsgesellschaft mbB has a legitimate interest in data processing for the following reasons:

  • Fast access to Jakob Steuerberatung’s website,

  • User-friendly application of website,

  • Check and maintain security and stability of the systems,

  • Facilitate and improve administration oft he website.

It is emphasized that the purpose of processing is not to gain knowledge about persons visiting the website.

 

4. Transfer of data

Personal data are transferred to third parties if

  • according to Article 6 para. 1 sentence 1 lit. a) GDPR the person concerned has explicitly agreed,

  • transfer according to Article 6 para. 1 sentence 1 lit. f) GDPR is required for claim, exercise or defense of legal rights without reason for the assumption that the person concerned has a predominant interest in the data not being transferred,

  • according to Article 6 para. 1 sentence 1 lit. c) GDPR a legal obligation exists for data transfer and/or

  • according to Article 6 para. 1 sentence 1 lit. b) GDPR this is required to fulfil a contractual relationship with the person concerned.

In other cases personal data are not transferred to third parties.

 

5. Your rights

Tot he extent your personal data are concerned when visiting our website, you have the following rights as „person concerned“ in the sense of GDPR:

5.1 Information

You can request from us information about whether or not your peronal data are processed by us. You have no right of information in case provision of the requested information would violate our obligation to confidentiality according to sec. 83 StBerG or in case the information has to be kept confidential for other reasons, in particular due to a predominant legitimate interest of a third party. Deviating from this, an obligation to provide information can exist if particularly under consideration of imminent damage your interest prevails interest to confidentiality. Right of information is excluded if data are only saved because they must not be deleted due to legal or statutory retention period or exclusively serve the purpose of data protection or data privacy control as far as providing information would require disproportionate effort and processing for other purposes is excluded by adequate technical and organizational measures. If the right of information is not excluded in your case and if your personal data are processed by us you can request the following information from us:

  • Purpose of processing,

  • Categories of your personal data processed,

  • Recipients or categories of recipients of your personal data, particularly in case of recipients in countries outside European Economic Area,

  • If possible, intended period during which your personal data dar saved or, if this is not possible, criteria for determination of saving period,

  • Existence of a right of correction or deletion or limitation of processing of your personal data or of a right of objection against processing,

  • Existence of a right of complaint with a competent authority,

  • In case personal data have not been obtainted from you as a person concerned available information on source of data,

  • If applicable, existence of an automated decision making including profiling and information on the logic involved as well as on scope and intended effects of automated decision making,

  • If applicable, in case of transfer to recipients outside EEA countries as far as no resolution of the European Commission about appropriateness of privacy level according to Article 45 para. 3 GDPR exists, information about which adequate guarantees according to Article 46 para. 2 GDPR are provided to protect personal data.

 

5.2 Correction and Completion

Should you realize that personal data concerning you are incorrect, you can request immediate correction from us. In case of incomplete personal data you can request completion. 

 

5.3 Deletion

You have the right of deletion („Right of being forgotten“) as far as processing is not requried for exercising the right of free speech, the right of information or for fulfilment of a legal obligation or for administration of a task in the public interest and if one oft he following reasons applies:

  • Personal data are no longer necessary for the purpose for which they have been processed.

  • Justification for processing was exclusively your consent which you have cancelled.

  • You have obejected against processing of your personal data which we have published.

  • You have objected against processing of personal data not published by us and no prevailing legitimate reasons for processing exist.

  • Your personal data have wrongfully been processed.

  • Deletion of personal data is required to comply with a legal obligation we are subject to.

No claim for deletion exists if deletion in case of legitimate, not automated processing would due to specific kind of saving not or only at an disproportionately high effort be possible and if your interest in deletion is low. In this case a limitation of processing replaces deletion.

5.4 Limitation of processing

You can request from us limitation of processing if one of the following reasons applies:

  • You challenge the correctness of your personal data. In this case, limitation can be requested for the time that enables us to review correctness of your data.

  • Processing is wrongful and you require limitation of processing of your personal data instead of deletion.

  • Your personal data are no longer required by us for the purpose of processing which, however, you need for enforcement, exercise or defense of legal claims.

  • You have objected according to Article 21 para. 1 GDPR. Limitation of processing can be requested for as long as it is inclear whether our legitimate reasons prevail your reasons.

Limitation of processing means that personal data can only be processed with your consent or for enforcement, exercise or defense of legal claims or in order to protect the rights of another individual or entity or for reason of an important public interest. Prior to ending limitation, we are obliged to inform you.

5.5 Data transferability

You have the right of data transferability in case processing is based on your consent (Article 6 para. 1 sentence 1 lit. a) or Article 9 para. 2 lit. a) GDPR) or on a contract which you are a party of and if processing is carried out by means of automated procedures. In this case, the right of data transferability includes the following rights as far as thereby rights and freedom of other persons are not concerned: You can request us to receive personal data you have provided us with in a structured, viable and machine readable format. You have the right to transfer these data to another responsible person without constraints.

As far as technically possible, you can request us to transfer your personal data directly to another responsible person.

 

5.6 Objection

To the extent processing is based on Article 6 para. 1 sentence 1 lit. e) GDPR or Article 6 para. 1 sentence 1 lit. f) GDPR you have the right to object to processing of your personal data at any time for reasons resulting from your specific situation. The same applies for profiling based on Article 6 para. 1 sentence 1 lit. e) or lit. f) GDPR. Upon exercising your right of objection, we no longer process your personal data unless we can prove compelling reasons for processing which prevail your interests, rights and freedom, or if processing serves enforcement, exercise or defense of legal claims

At any time, you can object to processing of your personal data for advertisement by direct mail. The same applies for profiling linked to such direct mail. Upon exercising your right of objection, we no longer use your personal data fort he purpose of direct mail.

You have the option to inform us about your objection by phone, by email, by fax or by mail to the address stated at the beginning of this Data Privacy Statement.

5.7 Cancellation of consent

At any time, you have the right to cancel your consent for the future. You have the option to inform us about your cancellation by phone, by email, by fax or by mail to our address. Legitimacy of processing based on your consent until cancellation, is not affected by your cancellation. Processing which was exclusively based on your consent is discontinued upon receipt of cancellation.

Should you be of the opinion that we have not complied with data privacy provisions in processing your data, you have the right to submit a complaint to the competent authority responsible for the place of your abode or work or for the place of assumed non-compliance.

6. Date and update of this Data Privacy Statement

This Data Privacy Statement is dated 25 May 2018. We reserve the right to update the Data Privacy Statement from time to time in order to improve data privacy and/or adapt to changes in practical application by authorities or jurisdiction.

Use of contact data published in the context of this imprint by third parties for sending advertising or information material not explicitly requested is explicitly objected. Operator of this website reserves the right to legal measures in case of unrequested sending of advertising or information material, e.g. by spam mail.
